119 EMERGENCY EFFECTIVE DATES

You will no longer be required to enter an effective date for a 119 emergency rule, the ERF System will automatically assign the effective date. R.C. 119.03(F) states that a 119 emergency rule "becomes effective on the date the rule, amendment, or rescission, in final form and in compliance with division (A)(2) of section 119.04 of the Revised Code, are filed in electronic form with the secretary of state, the director of the legislative service commission, and the joint committee on agency rule review." Thus, the effective date assigned to the emergency filing will be the date of the filing. This applies only to 119 emergency filings, not to 111.15 emergency filings.

PRIOR EFFECTIVE DATES AND REPLACEMENT LINES FOR NEW RULES

If you enter a prior effective date(s) for a new rule, you must also enter a replacement line. If you enter a replacement line for a new rule, you must also enter a prior effective date(s). If this condition is not met, you will see an error message explaining that you must enter data into both fields.

FILING AFTER HOURS
=========================
Filings can only be executed during normal business hours, 8:00am to 5:00pm. If you login to the ERF Website with a username that has filing privileges outside of business hours, the FILE button will be grayed out indicating a filing cannot be made. The FILE button will appear red only during the hours when a filing can be made.
