December Carry-over Reminder |
Good afternoon, Monday, November 30, is the last day to originally file, revise, or refile proposed rules before the December carry-over period of Revised Code section 119.03(I)(2) applies. R.C. 119.03(I)(2) requires that any proposed rule filed between December 1, 2009, and the first day of the General Assembly's next session have its JCARR jurisdiction period calculated as if it were originally filed on the first day of the General Assembly's next session. The General Assembly's 2010 session convenes January 5, 2010. Therefore, any proposed rule that you originally file, revise, or refile during the period beginning December 1, 2009, through January 4, 2010, will be subject to a 65-day JCARR jurisdiction that begins on January 5, 2010. Please consult with JCARR (614-466-4086) and plan carefully before electronically executing any original filing, revised filing, or refiling between December 1, 2009, and January 4, 2010. ONCE YOU SUBMIT A FILING ELECTRONICALLY, THE ACTION CANNOT BE REVERSED AND THE JURISDICTION PERIOD CANNOT BE ROLLED BACK. In most circumstances, it would be beneficial to delay a filing until January 5, 2010. Always call JCARR before electronically executing an original filing, revised filing, or refiling between December 1, 2009, and January 4, 2010.
