Electronic Rule-Filing Process

To amend or rescind a rule, an agency must request that LSC prepare the rule. This request must be made at least thirty days before the rule is needed for drafting. When the rule is prepared, the agency can download the rule from the Electronic Rule Repository and begin drafting using the Rule/RSFA Authoring System (RAS) software. To propose a new rule, an agency must draft the new rule using RAS.

When drafting is complete, the filer must log on to the ERF Website and create a new package. The following forms are also created on the ERF Website: Online Data and Supplemental Questions, RSFA Part A Rule Summary, RSFA Part A, Fiscal Analysis, RSFA Part B, the Environmental Impact Statement, and Incorporation by Reference. This information is used to create the RSFA and the rule history trail, establish the need for additional RSFA documents, and to determine which agencies will receive notification of the filing.

The filer then uploads all the necessary documents to the ERF Website and proceeds to file the package. The original filing is electronically filed with the appropriate agencies.

If a rule is subject to the sixty-five day jurisdiction of the Joint Committee on Agency Rule Review (JCARR), it can be revised, refiled, withdrawn, or placed in "To Be Refiled" status during that sixty-five day period. All of these actions are performed using the ERF Website.

When an agency is ready to final file a rule, it must log on to the ERF Website and prepare the rules that are to be final filed. After the filing is complete, the electronic certification "stamp" will appear on the last page of the rule, in the rule supplemental information. This electronic certification serves as the signature, and certifies that the electronically filed rules are true and accurate copies of the rules as adopted by the agency. An electronic certification is also used on emergency rules, five-year review (no change) filings, and withdrawals of proposed or final filed rules.
