What's New on November 18, 2004

The rule supplemental page has been reformatted

On the rule supplemental page (history trail), the "Promulgated Under," "Statutory Authority," "Rule Amplifies," and "Prior Effective Dates" lines are now left-aligned. This reformatting will appear on rules filed both before and after November 18, 2004. For example, if you use the History feature of the ERF Website to open a rule from a package that was filed on September 1, 2004, the rule supplemental page will render with the new formatting.

The expiration date question has been eliminated

The online question "Is there a date on which this rule will expire?" has been removed from the Online Data and Supplemental Questions (online question 10 in Typical and No Change packages, and question 6 in Internal Management, Special, and School packages). You are no longer able to enter an expiration date for a rule. All questions that follow the expiration date question have been renumbered accordingly. If an expiration date has been assigned to a rule that you filed in the past, that rule will continue to render with the assigned expiration date.

Rescissions filed in a Typical package: "Is the rule being filed consistent with the requirements of the RC 119.032 review?" defaults to Yes

When filing a rescission in a Typical package created or revised/refiled after November 18, 2004, the answer to the question regarding 119.032 review ("Is the rule being filed consistent with the requirements of the RC 119.032 review?") will default to "Yes." This default to "yes" will ensure that the current five-year review date associated with the rule to be rescinded will be removed upon final filing.

Internal Management, Special, and School packages: Withdraw Final will no longer show effective date

An effective date will no longer display on the rule body of a rule withdrawn (WDF) from an Internal Management, Special, or School package after November 18, 2004. A withdraw final action does not have an effective date. Prior to November 18, 2004, the effective date associated with the initial final filing was displaying on the rule body of a withdraw final in these three package types. (Rules withdrawn before November 18, 2004, will continue to display the effective date when rendered.)
